Photographer's Rights vs Privicy Rights

I was riding the Red Line tonight and I was asked about needed a release on my images and it reminded me of this photograph

Philip-Lorca diCorcia took this amazing image of Erno Nussenzweig a Jewish merchant in 2001. diCorcia's sold prints of this image for 10 of thousands of dollars.  (Yes, between 10 and 20 THOUSAND dollars)   Apparently it is against Nussenzweig's religious believes to have his picture taken.  Nussenzweig sued and lost.
